{"id":183460,"date":"2021-05-28T17:05:33","date_gmt":"2021-05-28T17:05:33","guid":{"rendered":"http:\/\/theadvocatespost.org\/?p=7920"},"modified":"2021-05-28T17:05:33","modified_gmt":"2021-05-28T17:05:33","slug":"advocates-contributes-to-special-rapporteur-thematic-report-on-rape","status":"publish","type":"post","link":"https:\/\/radiofree.asia\/2021\/05\/28\/advocates-contributes-to-special-rapporteur-thematic-report-on-rape\/","title":{"rendered":"Advocates Contributes to Special Rapporteur Thematic Report on Rape"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img src=\"https:\/\/global.unitednations.entermediadb.net\/assets\/mediadb\/services\/module\/asset\/downloads\/preset\/Libraries\/Production+Library\/20-04-2021-UNIS_Geneva-SRVAW-HRC.jpg\/image1024x768.jpg\" alt=\"\" \/><figcaption>UN Photo\/Jean-Marc Ferr\u00e9<br>Dubravka \u0160imonovi\u0107, Special Rapporteur on violence against women, one of the experts making the call.\u00a0<\/figcaption><\/figure>\n\n\n\n<p>U.N.\u00a0Special Rapporteur\u00a0on\u00a0Violence\u00a0against\u00a0Women\u00a0(VAW)\u00a0Dubravka\u00a0\u0160imonovic\u00a0has\u00a0released her\u00a0thematic\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/undocs.org\/A\/HRC\/47\/26\" >report<\/a>\u00a0on rape as a grave and systematic violation\u00a0of human rights and\u00a0gender-based\u00a0violence against women.\u00a0\u00a0The Advocates contributed\u00a0a\u00a0detailed\u00a0written\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/Women\/SR\/RapeReport\/CSOs\/089-minnesota.pdf\" >response<\/a>\u00a0to\u00a0the Special Rapporteur\u2019s\u00a0initial\u00a0request for\u00a0submissions\u00a0about local laws on rape and sexual violence.\u00a0The Advocates\u00a0also\u00a0joined\u00a0the Expert Group Meeting\u00a0on May 27,\u00a02020\u00a0to discuss a wide variety of issues\u00a0about\u00a0rape laws and implementation.\u00a0The Special Rapporteur invited\u00a0The\u00a0Advocates\u2019\u00a0Women\u2019s Program director Rosalyn\u00a0Park\u00a0to\u00a0that meeting\u00a0of worldwide experts\u00a0and cited\u00a0to\u00a0The Advocates\u2019\u00a0comments in\u00a0the\u00a0Expert Group Meeting\u2019s\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/Women\/SR\/Call_on_Rape\/EGM_EN-SR_Report.pdf\" >report<\/a>.\u00a0<\/p>\n\n\n\n<p>Based on input from dozens of organizations and states, the Special Rapporteur&nbsp;on VAW&nbsp;issued&nbsp;numerous conclusions and recommendations.&nbsp;Some notable recommendations&nbsp;for states\u2019&nbsp;legal framework&nbsp;addressing&nbsp;rape&nbsp;are:&nbsp;<\/p>\n\n\n\n<ul><li>The law should protect all persons, regardless of gender expression or sexual&nbsp;orientation&nbsp;<\/li><\/ul>\n\n\n\n<ul><li>Spousal rape should be criminalized, and states should abolish provisions mitigating consequences if the rapist marries the&nbsp;victim&nbsp;<\/li><li>Rape by a spouse should be an aggravating, rather than a mitigating, or nullifying,&nbsp;factor&nbsp;<\/li><li>Non-consent should be the central focus of rape statutes, without requiring proof of&nbsp;force&nbsp;<\/li><li>Force, injury, use of a weapon, exploitation of intoxication,&nbsp;and&nbsp;multiple perpetrators should be among the aggravating factors&nbsp;for rape, beyond the basic nonconsensual&nbsp;offense&nbsp;<\/li><li>The victim\u2019s testimony should not&nbsp;need&nbsp;further corroboration to be considered as evidence of&nbsp;rape&nbsp;<\/li><\/ul>\n\n\n\n<ul><li>The law should include rape shield provisions, to exclude from evidence the victim\u2019s previous sexual&nbsp;history&nbsp;<\/li><li>There should be no statute of limitations&nbsp;for rape, or&nbsp;at most, prolonged limitations periods&nbsp;permitting victims time to heal and for children to reach adulthood before initiating rape&nbsp;proceedings&nbsp;<\/li><li>States should collect data on prosecution, sentencing, and the attrition of reported rape&nbsp;cases&nbsp;<\/li><\/ul>\n\n\n\n<p>This report&nbsp;should help leaders craft statutes and response strategies to&nbsp;improve&nbsp;accountability for rape.&nbsp;<\/p>\n\n\n\n<p>The Advocates for Human Rights\u00a0thanks\u00a0the\u00a0U.N. Special Rapporteur\u00a0Dubravka\u00a0\u0160imonovic\u00a0for her six years\u2019 tenure\u00a0as the special rapporteur on violence against women.\u00a0Throughout the course of her appointment, she carried out numerous country visits to assess the situation of violence against women in countries including Georgia, Bulgaria,\u00a0Ecuador,\u00a0and Nepal. She issued several thematic reports on issues that spanned COVID-19 and domestic\u00a0violence, mistreatment and violence against women in childbirth, violence against women in politics, online violence against women, and shelters and protection orders.\u00a0The Advocates expresses its gratitude and congratulations to the U.N.
