Many politicians, academics, media pundits are wont of invoking the \u201crule of law\u201d, a \u201crules-based international order\u201d, \u201cvalues diplomacy\u201d etc.\u00a0 But what do all these benevolent-sounding slogans actually mean in practice?\u00a0 Who makes the rules, who interprets them, who enforces them?\u00a0 What transparency and accountability accompany these noble pledges?<\/p>\n
In a very real sense, we already have a \u201crules based international order\u201d in the form of the UN Charter and its \u201csupremacy clause\u201d, article 103 of which grants it priority over all other treaties and agreements.\u00a0 The norms established in the Charter are rational, but effective enforcement mechanisms are yet to be created.<\/p>\n
We also have humanistic \u201cvalues\u201d that should guide diplomacy and peace-making \u2013 including the principle \u201cpacta sunt servanda\u201d (treaties must be implemented, art. 26 of the Vienna Convention on the law of treaties).\u00a0<\/p>\n
