As environmental groups and experts express <\/span>fury and frustration<\/span><\/a> over <\/span>coal millionaire<\/span><\/a> Sen. Joe Manchin\u2019s (D-West Virginia) fossil fuel permitting overhaul deal released on Wednesday, Senate Democrats are highlighting concerns that the deal could set environmental justice advances back by years.<\/span><\/p>\n

In <\/span>a letter<\/span><\/a> sent to Senate Majority Leader Chuck Schumer (D-New York) on Thursday, eight senators, led by Jeff Merkley (D-Oregon), wrote that they share concerns expressed by environmental justice groups in recent weeks. They emphasized that the deal, which would <\/span>blow open<\/span><\/a> the <\/span>permitting process<\/span><\/a> for federal fossil fuel projects and <\/span>fast track dangerous<\/span><\/a> projects like the Mountain Valley Pipeline and potentially dozens of others, is especially dangerous for communities on the frontline of the climate crisis.<\/span><\/p>\n

\u201cFor many years, siting decisions for big infrastructure projects have essentially prioritized the perceived societal benefits of fossil energy over the very real costs disproportionately borne by communities of color, low-income communities, and others who have traditionally been marginalized,\u201d the lawmakers wrote. \u201cThe result has been the destruction of homes and neighborhoods, lost wealth in those communities, long-lasting health consequences, and premature deaths.\u201d<\/span><\/p>\n

The letter was signed by prominent lawmakers like Senators Ed Markey (D-Massachusetts), Bernie Sanders (I-Vermont) and Elizabeth Warren (D-Massachusetts).<\/span><\/p>\n

Lawmakers said that Manchin\u2019s (and <\/span>the American Petroleum Institute\u2019s<\/span><\/a>) proposed changes to landmark environmental laws like the National Environmental Policy Act (NEPA) and the Clean Water Act threaten to \u201csteamroll over\u201d protections for and public comments from frontline communities.<\/span><\/p>\n

While recent years have seen <\/span>some modest<\/span><\/a> investments<\/span><\/a> and <\/span>improvements<\/span><\/a> in environmental justice initiatives from Congress and the White House, Manchin\u2019s proposed deal could set those advancements back. <\/span><\/p>\n

\u201c[T]ransparency and the ability for potentially impacted communities to have prior, informed and meaningful participation and consideration are foundational to providing environmental justice,\u201d the lawmakers said. \u201cA number of the proposed permitting reforms would do the exact opposite.\u201d<\/span><\/p>\n

Congress should focus on strengthening protections and public participation for frontline communities \u2014 not rolling back those rights, the lawmakers said.<\/span><\/p>\n

Environmental, Appalachian, and other frontline groups <\/span>have expressed<\/span><\/a> strong discontent with the deal, and have spent the last weeks waging protests and sending letters in attempts to block the legislation from being passed. They say that allowing a deal like Manchin\u2019s to go through is tantamount to creating \u201c<\/span>sacrifice zones<\/span><\/a>\u201d out of communities that would experience the pollution and environmental degradation that inevitably <\/span>comes with projects like the Mountain Valley Pipeline<\/span><\/a>.<\/span><\/p>\n

Climate advocates and experts have said that the proposal shouldn\u2019t be characterized as a small deal made to appease Manchin, but rather <\/span>as a massive fossil fuel expansion bill<\/span><\/a> \u2014 one made to fulfill the industry\u2019s long-held wishes to weaken laws that force agencies to consider environmental impacts when reviewing federal projects. Indeed, Big Oil and Republicans <\/span>have been<\/span><\/a> trying for years<\/span><\/a> to slash NEPA and other environmental laws, just as Manchin has proposed.<\/span><\/p>\n

Democratic leaders <\/span>had planned to attach the deal<\/span><\/a> to a must-pass government funding bill that\u2019s due by the end of the month. But after Manchin released the text of the proposal on Wednesday, lawmakers from both <\/span>sides of the aisle<\/span><\/a> came out against the proposal, with those on the left saying that it would be disastrous for the climate. <\/span><\/p>\n

The lawmakers haven\u2019t directly called for the deal to be rejected, <\/span>but asked<\/span><\/a> for it to come to consideration as a stand-alone bill so that they can vote against it without risking a government shutdown. Sanders <\/span>has pledged<\/span><\/a> to vote against the funding bill if Manchin\u2019s proposal is attached. Meanwhile, even <\/span>some centrist<\/span><\/a> Democrats <\/span>are vowing<\/span><\/a> to do everything in their power to kill the deal, saying that it goes far past what they were expecting in terms of giveaways to the fossil fuel industry.<\/span><\/p>\n\n
