{"id":947870,"date":"2023-01-07T01:07:00","date_gmt":"2023-01-07T01:07:00","guid":{"rendered":"https:\/\/www.commondreams.org\/news\/january-6-trump-2024"},"modified":"2023-01-07T01:07:00","modified_gmt":"2023-01-07T01:07:00","slug":"jan-6-rally-reminds-public-that-trump-is-disqualified-from-running-for-office","status":"publish","type":"post","link":"https:\/\/radiofree.asia\/2023\/01\/07\/jan-6-rally-reminds-public-that-trump-is-disqualified-from-running-for-office\/","title":{"rendered":"Jan. 6 Rally Reminds Public That &#8216;Trump Is Disqualified&#8217; From Running for Office"},"content":{"rendered":"\n<img src=\"https:\/\/www.commondreams.org\/media-library\/members-of-mi-familia-vota-demonstrated-in-denver-colorado-on-january-6-2023.jpg?id=32641994&width=1200&height=800&coordinates=0%2C11%2C0%2C123\"\/><br\/><br\/><p>Two years after supporters of former President Donald Trump's \"Big Lie\" stormed the U.S. Capitol, demonstrators gathered in Colorado on Friday to remind the American people\u2014especially election officials\u2014that \"Trump is disqualified\"  from running for public office under Section 3 of the 14 Amendment to the Constitution. <\/p><p>Since January 6, 2021, some <a href=\"https:\/\/www.commondreams.org\/news\/2022\/12\/16\/you-dont-get-lead-government-you-tried-destroy-house-dems-move-block-trump-2024-run\" >elected officials<\/a> and <a href=\"https:\/\/www.commondreams.org\/news\/2022\/12\/17\/new-petition-pressures-us-house-members-not-seat-gop-insurrectionists-2023\" >advocacy groups<\/a> have drawn attention to that <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/section-3\/\" >section<\/a> of the amendment, which <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/section-3\/\" >bars<\/a> from office anyone who has taken an oath to support the Constitution and then \"engaged in insurrection or rebellion,\" to call for excluding Trump and some congressional Republicans from government.<\/p><p class=\"pull-quote\">\"Trump's actions were a violation of his oath of office and therefore make him constitutionally ineligible for any future run for office.\"<\/p><p>\"Insurrectionists do not belong in office,\" Rep. Ro Khanna (D-Calif.) <a href=\"https:\/\/www.commondreams.org\/news\/jan-6-insurrection\" >said<\/a> Friday. \"And they do not belong on the ballot going forward. Elected officials who directly aided and abetted the deadly assault on our nation's democracy on January 6 must be held accountable.\"<\/p><p>The groups Free Speech for People (FSFP) and Mi Familia Vota Education Fund have launched <a href=\"https:\/\/t.nylas.com\/t1\/277\/1doe8qor3s6cmlf15c3fen0vx\/3\/15788e7a551fbbf7869469e5baf1887d58ab00380750682eff3b308d1e77c574\" rel=\"noopener noreferrer\" >TrumpIsDisqualified.org<\/a>, a campaign pressuring secretaries of state and other U.S. election officials to exclude supporters of the insurrection\u2014particularly the twice-impeached former president\u2014from any future ballots.<\/p><p>As part of the \"Jan. 6th Justice: Our Freedoms, Our Votes\" <a href=\"https:\/\/www.commondreams.org\/news\/progressive-democrats-of-america-2659074000\" >day of action<\/a> on Friday, Mi Familia Vota held a rally in Denver demanding that Democratic Colorado Secretary of State Jenna Griswold use her power to keep Trump\u2014who formally <a href=\"https:\/\/www.commondreams.org\/news\/2022\/11\/16\/democracy-not-out-woods-yet-trump-announces-2024-white-house-run\" >launched<\/a> his current presidential campaign in November\u2014off the ballot in 2024. <\/p><blockquote class=\"rm-embed twitter-tweet\" data-partner=\"rebelmouse\" data-twitter-tweet-id=\"1611394208425996288\">\n<div style=\"margin:1em 0\">\\u201c@FSFP & MFV are urging Secretaries of State and chief election officials across the country to follow the mandate of Section 3 of the Fourteenth Amendment and bar Trump from any future ballot. Sign our petition: https:\/\/t.co\/61JKzYmle7\\u201d<\/div> \u2014 Mi Familia Vota (@Mi Familia Vota)\n        <a href=\"https:\/\/twitter.com\/MiFamiliaVota\/status\/1611394213219913732\">1673021292<\/a>\n<\/blockquote>\n<script async=\"\" charset=\"utf-8\" src=\"https:\/\/platform.twitter.com\/widgets.js\"><\/script>\n<p>Ahead of the \"<a href=\"https:\/\/www.nytimes.com\/2023\/01\/03\/us\/house-speaker-mccarthy-election.html\" >divided and disoriented<\/a>\" GOP's disastrous takeover of the U.S. House of Representatives this week, the Democratic-led select committee that investigated the Capitol insurrection last month unanimously <a href=\"https:\/\/www.commondreams.org\/news\/2022\/12\/11\/there-evidence-criminality-jan-6-panel-meets-decide-referrals-doj\" >referred<\/a> Trump to the U.S. Department of Justice (DOJ) on four criminal charges.<br\/><\/p><p>\"The bipartisan House January 6th committee showed that Trump engaged in a criminal conspiracy to overturn the results of the 2020 election, culminating with his incitement of violent insurrection,\" FSFP campaign director Alexandra Flores-Quilty said Friday. <\/p><p>\"The insurrectionist disqualification clause is clear: Trump's actions were a violation of his oath of office and therefore make him constitutionally ineligible for any future run for office under Section 3 of the 14th Amendment,\" she added. \"Secretaries of state now have a duty to uphold the Constitution and protect our democracy by ensuring Trump is barred from the ballot.\"<\/p><p>Even before the House select committee referrals,  Trump faced DOJ investigations into his handling of classified documents and his role in the 2021 attack on the Capitol.  After Trump announced his 2024 campaign, U.S. Attorney General Merrick Garland <a href=\"https:\/\/www.commondreams.org\/news\/2022\/11\/18\/ag-merrick-garland-appoints-special-counsel-oversee-trump-probes\" >appointed<\/a> Jack Smith, a longtime federal prosecutor,  as a special counsel for those probes.<\/p><p>FSFP legal director  Ron Fein, president John Bonifaz, and chairman and senior legal adviser Ben Clements, jointly <a href=\"https:\/\/www.jurist.org\/commentary\/2023\/01\/merrick-garland-abandoned-prosecuting-trumps-pre-2020-crimes\/\" >argued<\/a> Friday in a piece for <em>Jurist<\/em> that \"Garland has done something quietly sneaky\" with his appointment of Smith.<br\/><\/p><blockquote class=\"rm-embed twitter-tweet\" data-partner=\"rebelmouse\" data-twitter-tweet-id=\"1611402085420908554\">\n<div style=\"margin:1em 0\">\\u201cTrump must be held accountable for his insurrection crimes (& later theft of government documents). \\n\\n\\ud835\\uddd5\\ud835\\ude02\\ud835\\ude01 AG Garland's absolution of Trump\\u2019s earlier crimes\\u2014and unwillingness to even state openly that he was doing so, let alone explain why\\u2014is a serious blow to the rule of law.\\u201d<\/div> \u2014 Ron Fein ... also ronfein@masto.ai (@Ron Fein ... also ronfein@masto.ai)\n        <a href=\"https:\/\/twitter.com\/ronfein\/status\/1611402085420908554\">1673023170<\/a>\n<\/blockquote>\n<script async=\"\" charset=\"utf-8\" src=\"https:\/\/platform.twitter.com\/widgets.js\"><\/script>\n<p>\"By announcing a special counsel appointment predicated on Trump's candidacy,\" the trio wrote, \"then excluding from the special counsel's scope the 'shelf-ready' 'obstruction of justice crimes already identified by Special Counsel [Robert] Mueller and campaign finance crimes already identified by Manhattan prosecutors (in the Trump administration, no less), Garland is telling us between the lines that that he is giving up on all of Trump's pre-2020 crimes.\"<\/p><p>\"Of course, Trump must be held accountable, in a timely fashion, for the crimes within the special counsel's scope,\" they added. \"But Garland's absolution of Trump's earlier crimes\u2014and unwillingness to even state openly, let alone provide a rationale, that he was doing so\u2014is a serious blow to the once cherished principle that no one, not even the president, is above the law.\"<\/p><p>As for other political leaders who contributed to the Capitol attack, although the select committee last month <a href=\"https:\/\/www.commondreams.org\/news\/2022\/12\/19\/time-prosecute-jan-6-panel-unanimously-refers-trump-doj-criminal-charges\" >referred<\/a> Republican Congressmen Andy Biggs (Ariz.), Jim Jordan (Ohio),  Kevin McCarthy (Calif.), and Scott Perry (R-Pa.) to the House Committee on Ethics for defying subpoenas, they are unlikely to face any consequences in a chamber narrowly controlled by the GOP, no matter who ultimately becomes speaker.<\/p><p>The House adjourned Friday afternoon after 13 failed speaker votes throughout the week\u2014the most since <a href=\"https:\/\/www.commondreams.org\/news\/house-republicans-2659077348\" >before the U.S. Civil War<\/a>\u2014with plans to return at 10:00 pm ET. McCarthy just needs to flip two of the six Republicans who remain opposed to him\u2014Biggs along with Reps.
